CAFC affirmed that an intent to deceive in renewal of a registration required making a statement while knowing the statement to be false. Mere mistake or negligence does not rise to fraud on the USPTO.

Trademarks have been used since time immemorial in one fashion or another. Persons faces and names became associated with goods or services ever since man began trading with others for goods and services. Individuals and guilds established their own marks, as did countries.
A trademark attorney is generally an attorney admitted to the bar of at least one state who practices in the intellectual property field of trademark law.

Trademarks identify a company or person as the source of goods or services (service marks) being offered for sale.

There are two federal trademark registers - the Principal Register and the Supplemental Register.
